Terms and Conditions
1. General conditions
Sales of Crosshead bicycles and accessories whether by internet, e-mail or mail shall be governed by these terms and conditions.
Crosshead customers whether individuals or business purchase are governed and supplied for use by an individual user only. A customer is an individual or a business person who is using the Crosshead bicycle for leisure, between home and work but not commercially for income purposes.
Placing an order via the Crosshead internet site requires the purchaser to agree to the above terms and agreement to this and all our business terms. Our customers are purchasing a pre-sales product, an early and temporary business condition allowing Crosshead to progress successfully through the early manufacturing stage. Our product offer is subject to constant review and modification and pricing and availability are subject to change without notice.
Standard business conditions do not apply regardless of whether or not we expressly object to them in a particular case. This contract becomes active upon receipt of a Crosshead bicycle or related product and Product & Services specified and published on the Crosshead site and in catalogues are non-binding.
2. Conclusion of contract
By placing an order through the Internet Shop (which requires prior registration and acceptance of these General Terms and Conditions), the Customer makes a binding offer to purchase the relevant product.
Any Customer who is a Consumer shall be entitled to revoke the offer and return the product in accordance with the cancellation and return policy as separately made available to the Customer in connection with the e-mail confirming receipt of the order.
3. Payment and Delivery
The price of the product includes VAT for UK and EU countries and does not include delivery, which is priced separately. Where we agree to deliver outside of these territories taxes will be paid by our customers as requested by local customs control and delivery is shown as a separate cost. Payment to Crosshead for products via our website will be made in full.
By placing an order and paying for your purchase you enter into a pre-sales agreement and accept the terms. Orders may take longer than estimated to be completed due to our early production capability. Therefore we will deliver your order as quickly as practicable and delays are possible until we remove our pre-sales status.
We are a premium product manufacturer and appreciate customers e-mailing us at info@crosshead.co.uk in regard to their order allowing us to remain in contact during the pre-sales period.
4. Retention of title and resale
We retain the legal title to any product supplied by us until the purchase price (including VAT and shipping costs) for such product has been fully paid.
5. Shipment, Insurance and allocation of risk
Crosshead folding bikes are fully assembled and adjusted by qualified technicians in our factory, no parts are shipped separately.
We shall be free to determine the appropriate mode of shipment and to select the carrier at our reasonable discretion. We shall bear the risk of transport in case the Customer is a consumer.
We are obliged to properly and timely deliver the product to the carrier, and any transit times specified in the Internet Store shall only be non-binding estimates.
The risk of accidental destruction, damage or loss of the delivered product shall pass to the Customer upon delivery of the product to the Customer or upon the Customer’s default of acceptance. In all other cases, such risk shall pass to the Customer upon delivery of the product by us to the carrier.
The Customer shall bear the shipping costs. The shipping costs include the costs for a transport insurance against the usual risks of transportation. We will inform the Customer of the shipping costs in the order form.
The Customer shall bear the usual return shipping costs when exercising the right to return goods to the Crosshead factory.
6. Cancellation of order
We are bound by ‘Distance Selling Regulations’ which provide customers 7 days to decide whether or not to cancel their order following payment.
7. Data Protection
We will save and utilise your sales contact data in relation to the sales transaction, will retain and protect in line with UK data law and not pass on to a third party.
8. UK Law
These Terms and Conditions whereby we offer our products and services to customers is construed in accordance with the laws of the United Kingdom.
